Likewise, the contents and services available to Users on this Website may be regulated by specific terms of use which, in the event of conflict, shall prevail over these general terms of use.
UNIQ RESIDENTIAL, S.L. reserves the right to modify any information that may appear on the Website (including, without limitation, these general terms of use and, where applicable, the specific terms of use), without the need to inform or forewarn Users of such modification. In this sense, the publication of any modification of the information that may appear on the Website will be deemed to be, informed to the Users with the publication in the Website. Consequently, the User must carefully read the general terms of use each time he or she uses the Website as well as, if applicable, the corresponding specific terms of use each time he or she uses the relevant content or service.

You fully and unreservedly agree the provisions contained in the general terms of use, and, if applicable, in the specific terms of use, of this Website, in the version published by UNIQ RESIDENTIAL, S.L. at the same moment that the User accesses the Website.

The Website can be visited freely and its use will be free of charge, without prejudice to the network cost for the user to access the corresponding telecommunication network (unless otherwise indicated in the specific terms of use, where applicable). The User undertakes to use the contents and services in accordance with the law, ethical, good manners and these general terms of use. To this end, the User will not use the Website for purposes or effects that are illicit, prohibited and harmful of rights and interests of UNIQ RESIDENTIAL, S.L. or third parties, in such a way that could damage, disable or overload the Website, or that would prevent, in any way, the normal use of the Website.
UNIQ RESIDENTIAL, S.L. is not responsible for any errors or omissions, the contents of the Website or other content which may be accessed through it, or for damages arising from the use of the Website, or for any action taken on the basis the information provided therein.

UNIQ RESIDENTIAL, S.L. adopts reasonably adequate security measures to detect the existence of viruses. However, the security measures for Internet computer systems are not entirely reliable and, therefore, UNIQ RESIDENTIAL, S.L. neither guarantees the absence of viruses or other harmful elements that may cause damage or alterations in the computer system (software and hardware), electronic documents or files of the Users of the Website, nor answers for damages that such elements may cause to Users or third parties. The Website is informative, so its contents can be modified, extended or deleted at any time, without prior notice.

Intellectual and industrial property rights

All rights of intellectual property of the Website and all its contents (texts, images, designs, creativities, software, code source, fragment of audio, computer programs, digital downloads, data bases, trade names, trademarks, logos, or any other distinctive sign, etc.) that are or have formed part of it at some point, are protected by law and belong to UNIQ RESIDENTIAL, S.L.
In no event shall mean that access to and use of the Website implies the waiver, transmission, license, transfer, totally or partially, or authorization of any kind, for the exploitation, reproduction, public communication, broadcasting, dissemination and/or transformation of the Website or its contents, as broad as it could be understood in the previous point, nor of the intellectual and/or industrial property rights inherent thereto.

Consequently, the User is expressly forbidden to reproduce, transform, distribute, publicly communicate, make available, extract, reuse, resend or use in any way, by any means or procedure, any of these contents, except in cases where it is legally permitted or authorised by the holder of the relevant rights.

Customer protection

SELECCIÓN DE INMUEBLES, S. L. (with tax Identification no. B-83435503, registered office at Calle María de Molina 6, 5º A, 28006, Madrid, and registered with the Commercial Registry of Madrid, in Volume 18,539, Page 169, Sheet M-322,249) (the “Property”) which owns the development of residential dwellings for future construction located at Paseo de la Habana, no. 147, 28036, Madrid (currently registered plot no. 25,024 of the Land Registry of Madrid no. 29, and pending its horizontal division) (the “Dwellings”), has contracted UNIQ RESIDENTIAL, S.L. to provide certain services.
All the information regarding the Dwellings included in this Website, including images, photographs, illustrations, computer graphics, virtual tours, designs, maps, surfaces and the description of the common services (jointly, the “Website Information”) is merely illustrative, has been prepared for guidance purposes only and under no circumstances can it be considered as final or definitive.

The photographs, illustrations, computer graphics, virtual tours, designs, maps, plans, 3D models and any other graphic information about the Dwellings (including their indoor spaces, common areas, façades, services, etc.), included or that may be included amongst the Website Information (the “Graphic Information”), has also been prepared for guidance purposes, and in most cases are generic prints digitally created whose sole purpose is to show the User how the final appearance of the Dwellings could be once their construction has been completed.

The Website Information, including the Graphic Information, will be subject in all cases to the content of the technical projects relating to the development and construction of the Dwellings, as well as to their subsequent modifications. The equipment and materials used in the construction of the Dwellings will be those indicated in the quality report (memoria de calidades).

The Property and UNIQ RESIDENTIAL, S.L. reserve the right to modify the Website Information at any time and without prior notice, as well as the right to introduce in the Website Information any changes, variations, substitutions, clarifications and/or modifications that are necessary or convenient for any reason, including technical, commercial or legal grounds that make it advisable, or when ordered by the relevant public authorities.

The User acknowledges and expressly accepts that there could be differences between the Website Information and the characteristics of the Dwellings once they are completely built.

The Website Information does not constitute a contractual offer subject to acceptance or binding for the Property and/or UNIQ RESIDENTIAL, S.L., nor can it be understood as an invitation or proposal to purchase products or services from the Property, UNIQ RESIDENTIAL, S.L. or any other third party.

All the information required in accordance with the General Consumer Protection Law, whose revised text was approved by the Royal Legislative Decree 1/2007, of 16 November, Royal Decree 515/1989, of 21 April, on the consumer protection with regard to the information to be provided in the sale and purchase and rental of housing, Law 2/1999, of 17 March, of the Community of Madrid on building quality measures, as well as in other related legislation, is available to the public and, where appropriate, to the relevant public authorities at UNIQ RESIDENTIAL, S.L.’s offices (Plaza de San Juan de la Cruz, no. 4, 28003, Madrid) subject in all cases to its availability as the development and construction of the Dwellings progresses.

In particular, the Users are informed that on 7 May 2020 the mandatory works licence, which will allow the commencement of the construction of the Dwellings, was duly obtained. Additionally, any other information or circumstances considered relevant in relation to the construction works of the Dwellings will be uploaded to the Website for information purposes.

In order to obtain additional detailed information related to the Dwellings or, if applicable, to confirm the Website Information, the User shall send the “Would you like more information?” form included on the Website. All the data provided on this form will be incorporated into a file owned by UNIQ RESIDENTIAL, S.L. under the terms and conditions set forth in the Privacy Policy.

Neither the Property nor UNIQ RESIDENTIAL, S.L. or any of their respective group companies, employees, agents or partners make any representation, statement or warranty regarding the Website Information, nor do they assume any liability to Users for any errors or omissions in the Website Information.

The Property will act at all times in compliance with the provisions of Law 38/1999, of 5 November, on Building Standards, especially with regard to its first additional provision concerning the collection of amounts on account of the price of the Dwellings during their construction. In this sense, it is expressly stated that the credit institution that will guarantee the return of the amounts paid on account of the price of the Dwellings by means of a bank guarantee will be Banco Sabadell, S.A., credit entity in which a specific account has been opened for the collection of such amounts.

Applicable law and jurisdiction

The terms and conditions of this Website are governed by Spanish law and, unless otherwise established in the applicable regulations (including the consumer protection law), any conflict will be submitted by the parties to the judges and courts of the city of Madrid.
